Court of Appeal in Abuja yesterday, 13th of October 2022, discharged and acquitted Mazi Nnamdi Kanu, leader of the Indigenous People of Biafra (IPOB), on the ground that due process was not followed in his extradition into Nigeria by the Federal Government.
The court mad it clear that extraordinary rendition is a gross violation of local and international laws after the defence counsel was unable to provide any evidence showing that Nnamdi Kanu was lawfully extradited from Kenya to Nigeria.
In continuity with the pronouncement, the Appeal Court judges couldn't hide their displeasure with the Federal Government of Nigeria and emphasised that "no government of the world has the right to extradit anyone without due process."
"When the issue of jurisdiction was raised, the court is duty bound to obey," the court further said. In delivering judgment, the the judges of the Appeal Court stated clearly that "The court must make sure that law and order are balanced and to curtail the excesses of the executive."
Declaring Mazi Nnamdi Kanu's abduction and extraordinary rendition from Kenya illegal and consequently constitutes a bar to further trials. The court held that it was done in clear and agregious violation of extant international laws.
"There is no justification whatsoever to present him to judgement even after the manner he was brought into Nigeria by the Federal Government. The bench warrant of arrest issued in Nigeria is not enough to justify the illegal abduction and smuggled into Nigeria of Nnamdi Kanu."
Mazi Nnamdi kanu had through his defence counsel led by Barrister Mike Ezekhome (SAN) filled an appeal against the decision of Justice Binta Nyako of the Federal High Court Abuja not to strike out the remaining 7 count charges against him by the Federal Government after 8 of the initial 15 count charges was either dropped or struck out by the persecuting counsel led by Barrister Labaran and Justice Binta Nyako of FHC Abuja.
The defence counsel representing the FG had amended the charges and removed one charge from the remaining seven count charges when the case was first argued at the Court of Appeal last month.
Based on the illegality of how Nnamdi Kanu was abducted, smuggled into Nigeria, and forcefully arraigned in court, the Appeal Court judges ruled that their is no legality in the trial of Mazi Nnamdi Kanu. Therefore, he was discharged and acquitted.
The ruling of the Appeal Court was greeted with joy and jubilation by Biafrans, followers and lovers of Mazi Nnamdi Kanu worldwide.
